Terms of Service

The agreement between you and Commz.

Effective September 20, 2026 · Version 1.1

These Terms of Service ("Terms") are a binding agreement between you and Caleb Alan Mahan, operating the Commz service ("Commz," "we," "us," or "our"). They govern your use of commz.net, app.commz.net, the Commz desktop app, the Commz Bot API, and any related services (together, the "Service"). Please read them carefully. Our Privacy Policy and SMS Messaging Terms are part of these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. When you create an account you are asked to confirm that you accept these Terms and the Privacy Policy with a checkbox that is separate from any other choice on the form.

2. Eligibility and Age Requirements

You must be at least 13 years old to create an account or use Commz. By registering, you represent that you are at least 13 years old. We collect your date of birth at registration to enforce this requirement.

Some areas of the Service are designated as adult content (18+). To access 18+ content, you must be at least 18 years old. If you are under 18, you may not access content marked as adult under any circumstances. We may immediately terminate any account found to have provided false age information.

3. Account Registration and Security

You must provide accurate, current, and complete information when registering, and keep it up to date. You are responsible for all activity that occurs under your account.

You agree to:

Two-factor authentication. You can add a second sign-in factor in Settings → Security. Commz supports authenticator apps (time-based one-time codes) and, where we have enabled them, one-time codes sent by email or text message. You are responsible for keeping a backup of your authenticator app and for enrolling a backup method before you lose access to your primary one. Removing a factor requires your password and a code from an enrolled method. A password reset does not turn off two-factor authentication.

Lost access. If you lose every enrolled factor, contact support@commz.net. We will only restore access after verifying that you own the account using records we already hold. An email address alone is not proof of ownership, and we may decline a request we cannot verify.

Signed-in devices. You can review the devices signed in to your account and sign out other devices in Settings → Security. We may end sessions or require you to sign in again to protect your account.

We may disable, suspend, or delete accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

18+ communities are permitted for adult content between consenting adults, provided the community is properly marked as 18+, every person depicted is 18 or older and consenting, and the content complies with applicable law.

5. User Content

You retain ownership of content you post on Commz. By posting content, you grant Commz a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, distribute, display, and create derivative works of your content solely for the purpose of operating, securing, and improving the Service.

You represent and warrant that you own or have the right to share the content you post, that it does not infringe any third-party rights, and that it complies with these Terms.

We do not pre-screen content, but we may remove content and suspend accounts that violate these Terms at our sole discretion. Community owners and moderators can also remove content and members from their own communities.

6. Files and Attachments

Files you share in chat, tickets, and reports are stored privately and made available only to people who can already see the conversation. Every file is checked for malware before it can be downloaded. Files that fail a check, cannot be verified, or use a format we do not support are blocked and removed. Plan limits on file size and supported formats apply and may change.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act. Our full notice, counter-notice, and repeat-infringer procedures are published in our DMCA Copyright Policy. Notices go to our designated agent:

Accounts that repeatedly infringe copyright will be permanently terminated.

8. Payments, Subscriptions, and Tips

Commz plans. Commz offers optional paid plans: Commz Pro ($4.99 per month) and Commz Creator ($9.99 per month). Plans are billed monthly and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and we do not prorate refunds for the remainder of a period. Plan features and limits are described on commz.net and in the app and may change; we will give reasonable notice of material reductions.

Creator subscriptions. Creators can offer a monthly subscription to their community for $4.99 per month. Commz keeps a platform fee of 15% of each creator subscription payment; the remainder, minus Stripe processing fees, is paid to the creator.

Tips. You can send one-time tips of $1 to $500 to creators who have enabled tipping. Commz keeps a platform fee of 10% of each tip; the remainder, minus Stripe processing fees, is paid to the creator.

Receiving payouts. To receive tips or creator subscriptions you must complete Stripe onboarding, and you agree to the Stripe Connected Account Agreement. You are responsible for any taxes on payments you receive. We will provide tax forms where the law requires it (for example, a 1099-K for US creators above IRS thresholds).

Payment processing. All payments are processed by Stripe, Inc. Your card details are sent directly to Stripe and are never stored on our servers. Stripe's use of your personal data is governed by Stripe's Privacy Policy.

Refunds. Plan fees are non-refundable except where required by law. Tips and creator subscription payments are non-refundable once completed. If you believe a payment was made in error or fraudulently, contact support@commz.net within 30 days.

9. Streaming, Clips, and Live Content

When you stream on Commz, you represent that you have all necessary rights and licenses for the content you stream (including music, games, and third-party footage), that you will comply with all applicable laws, and that you will not stream content that violates our Acceptable Use policy. Viewers can create short clips of live streams; clips are posted to a community channel and are treated as user content under these Terms.

We use Amazon Interactive Video Service (IVS) for streaming and LiveKit for voice, video, and screen sharing. Stream, voice, and video data passes through this infrastructure so that other participants can receive it. By streaming or joining a room, you consent to this processing.

10. Encrypted Direct Messages

Commz offers optional end-to-end encryption for the text of direct messages once every participant has approved it. It covers new message text only: attachments, calls, participant identities, timestamps, and other metadata are not encrypted end to end. You are responsible for keeping your recovery backup safe; if you lose every approved device and your backup, encrypted messages cannot be recovered by us. Because we cannot read encrypted messages, they cannot be reported to Commz; you can still report or block the user. This encryption has not been independently audited.

11. Bots and the Developer Platform

You may create bots that connect to Commz through the Bot API. A bot acts under a token issued to you; keep it secret and rotate it if it is exposed. Community administrators choose whether to install your bot and which permissions it gets, and they can remove it at any time. Bots must follow these Terms, the published API documentation, and our rate limits, and must not collect more data than they need. We may disable a bot or revoke its access at any time to protect the Service or its users.

12. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data described there.

13. Third-Party Services

Commz relies on third-party services, including Amazon Web Services (Cognito for sign-in and two-factor authentication, DynamoDB, S3, IVS, Amazon SES for email delivery, AWS End User Messaging for text messages, and Amazon GuardDuty for malware scanning), Stripe for payments, LiveKit for real-time voice and video, and GitHub for distributing desktop app downloads and updates. Your use of these services is subject to their terms and privacy policies. We are not responsible for the practices of third parties.

14. Account Deletion, Suspension, and Termination

You can request deletion of your account in Settings → Security. Your account is deactivated immediately and you have 30 days to cancel the request or export your data before final deletion runs. Communities you own are transferred to an eligible member or archived when nobody is eligible.

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms, extended inactivity, or a request from law enforcement. Suspended accounts cannot post, join voice, stream, upload, or make other changes. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that malware scanning will catch every threat, or that messages, codes, or notifications will be delivered on time. We are not responsible for user-generated content posted on the platform.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMZ AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO COMMZ IN THE TWELVE MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless Commz and its owners, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your content, your bots, your violation of these Terms, or your violation of any applicable law or third-party rights.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS.

19. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms at commz.net/legal/terms and in the app, and by updating the effective date and version above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
